Terms and Conditions: MEGATRON 5.1kwh Lithium Battery Giveaway Competition

1. Introduction

1.1. This competition ("Competition") is conducted by The World of Wind and Sun Power ("The Promoter").
1.2. By entering the Competition, participants agree to be bound by these terms and conditions.
1.3. The Competition is open to residents of South Africa only, aged 18 years or older, excluding employees of The Promoter, their immediate families, agents, or any other person professionally connected to the Competition.

2. Competition Period

2.1. The Competition will run from 9 September to 9 November 2024. Entries received after the closing date will not be considered.
2.2. The Promoter reserves the right to amend the competition period and will communicate such changes through its official Facebook page and website.

3. How to Enter

3.1. To enter the Competition, participants must:

• Like the Page: https://www.facebook.com/worldofsunpower/
• Share the post publicly.
• Tag at least three friend in the comments of the giveaway post.
• 3.2. For double entries:
• Existing customers may submit a video review of their experience with The World of Wind and Sun Power and post it on their social media, tagging The Promoter's account.
• Alternatively, if participants are camera-shy, they may leave a review on The Promoter’s Facebook page: https://www.facebook.com/worldofsunpower/reviews.
• Each participant is limited to one entry
• Entries that are incomplete, illegible, or do not adhere to the rules will be disqualified.

4. Eligibility

4.1. The Competition is open to South African residents only, who are 18 years or older.
4.2. Participants must have a valid South African ID or passport and be able to provide proof of residency upon request.
4.3. The Promoter reserves the right to request proof of age, residency, or any other eligibility criteria from any participant before awarding the prize.

5. Prize

5.1. The prize for this competition is a MEGATRON 5.1kwh Lithium Battery.
5.2. The prize is non-transferable and cannot be exchanged for cash or any other products/services.
5.3. The Promoter reserves the right to substitute the prize with another of similar value in the event the original prize offered is unavailable.

6. Winner Selection and Notification

6.1. The winner will be selected randomly from all valid entries received during the competition period.
6.2. The draw will be conducted on the 10^th of November.
6.3. The winner will be notified via direct message on Facebook or by email (if applicable).
6.4. If the winner cannot be contacted or fails to respond within 7 days of the first notification attempt, the Promoter reserves the right to draw a replacement winner.

7. Prize Delivery

8. Data Protection and Privacy

8.1. By entering the Competition, participants agree that their personal information may be collected and processed by The Promoter for the purposes of the competition, including the administration of the competition and prize fulfillment.
8.2. The Promoter will not disclose participants' personal information to third parties without their consent, except for the purpose of delivering the prize.
8.3. The Promoter will handle personal information in accordance with applicable data protection laws, including the Protection of Personal Information Act, 2013 (POPIA).

9. Publicity

9.1. By entering the Competition, participants consent to the use of their name, image, and video submissions (if applicable) by The Promoter for promotional and marketing purposes in connection with this Competition, without any further compensation, unless prohibited by law.
9.2. The winner agrees to participate in reasonable promotional activities as requested by The Promoter, including but not limited to interviews, photographs, and social media posts.

10. General Conditions

10.1. The Promoter reserves the right to disqualify any participant found to be tampering with the entry process or in breach of these Terms and Conditions.
10.2. The Promoter reserves the right to cancel, suspend, or amend the competition or these terms and conditions where necessary due to unforeseen circumstances or events outside of their control.
10.3. The Promoter is not responsible for any technical failures, lost, delayed, or misdirected entries, or any other errors outside their reasonable control.
10.4. The Promoter accepts no responsibility for any loss, damage, injury, or death resulting from participation in the competition or the use of the prize, except where caused by gross negligence.

11. Limitation of Liability

11.1. To the maximum extent permitted by law, The Promoter will not be liable for any loss, damage, or injury arising from participation in the Competition or acceptance of the prize.
11.2. In the event of unforeseen circumstances, The Promoter reserves the right to amend these terms or withdraw the competition without liability.

12. Governing Law

12.1. These terms and conditions are governed by the laws of South Africa, and any disputes will be subject to the exclusive jurisdiction of the South African courts.

13. Exclusion of Employees and Affiliates
    13.1. Employees, directors, and agents of The World of Wind and Sun Power, as well as their immediate families (spouse, life partner, parents, siblings, and children), are not eligible to participate in this Competition.
    13.2. In addition, any affiliates, partners, suppliers, or anyone professionally connected to The Promoter or the administration of this Competition are also excluded from entry.
14. Final Decision
    14.1. The Promoter's decision regarding any aspect of the Competition, including but not limited to the selection of the winner, is final and binding.
    14.2. No correspondence or discussions will be entered into regarding the outcome or any decisions related to the Competition.
